TERMS AND CONDITIONS OF THE ONLINE STORE AZAD YAKUBOV

I. GENERAL PROVISIONS

  1. The owner and operator of the online store is:

  2. These Terms and Conditions come into effect on February 1, 2025, and are available on the store's website in a format that allows for downloading, saving, and printing.

  3. The store operates in accordance with Polish law, particularly:

    • The Consumer Rights Act of May 30, 2014 (Journal of Laws of 2020, item 287, as amended),
    • The Civil Code,
    • Data protection regulations, including GDPR (Regulation (EU) 2016/679 of the European Parliament and of the Council) and national laws.
  4. Use of the store requires familiarization with and acceptance of these Terms and Conditions.

II. DEFINITIONS

  1. Customer – a natural person (including Consumer), legal entity, or organizational unit without legal personality, making purchases in the store.
  2. Consumer – a Customer who is a natural person making a purchase for purposes not directly related to their business or professional activity (in accordance with Article 221 of the Civil Code).
  3. Seller – Azad Yakubov, operating the online store.
  4. Product – a movable item available in the store that can be the subject of a Sales Agreement.
  5. Sales Agreement – a distance contract concluded between the Seller and the Customer through the store.

III. ORDER PLACEMENT PROCESS

  1. Orders in the store can be placed through the electronic order form available on the store's website.

  2. When placing an order, the Customer is required to provide correct and complete data enabling order fulfillment (including name, address, email, phone number).

  3. The Seller confirms order acceptance via email within 24 hours of placement. The confirmation message may include information about the order fulfillment time and payment details.

  4. The Sales Agreement is concluded when the Customer receives order confirmation from the Seller.

IV. PAYMENT TERMS

  1. Accepted payment methods:

    • Bank transfer (payable within 3 business days of order placement),
    • Credit/debit card,
    • Online payment systems (e.g., PayU, Przelewy24).
  2. All prices shown in the store are gross prices (including VAT) and expressed in Polish zloty (PLN). The Product price does not include delivery costs, which are presented to the Customer during order placement.

  3. If payment is not received within the specified time, the order will be cancelled.

V. DELIVERY

  1. The Customer chooses from available delivery methods during order placement. Delivery costs are covered by the Customer unless otherwise stated in the terms or offer.

  2. Standard delivery time is 2 to 4 business days (for products available in stock). The Seller informs about the expected delivery time during order finalization.

  3. The Seller is not responsible for delays caused by the carrier if due diligence was maintained in transferring the shipment according to the time specified in the order.

  4. The risk of loss or damage to the shipment passes to the Customer when it is handed over to the carrier (in accordance with Article 548 § 1 of the Civil Code); however, for Consumers – only upon actual receipt of the shipment.

VI. RIGHT OF WITHDRAWAL (RETURN)

  1. The Consumer has the right to withdraw from the Sales Agreement within 14 days without giving a reason, counting from the day the Consumer took possession of the product (or when a third party other than the carrier and indicated by the Consumer took possession of the product).

  2. To exercise the right of withdrawal, the Consumer should submit an unambiguous statement to the Seller, for example by:

  3. The Consumer may use the model withdrawal form, but it is not mandatory.

  4. The condition for return is sending back the product unused, in its original packaging (if possible), and in a way ensuring its safe transport. The Consumer bears the direct costs of returning the goods.

  5. The Seller will refund all payments made by the Consumer, including delivery costs (except for additional costs resulting from the Consumer choosing a delivery method other than the least expensive standard delivery method offered by the Seller) immediately, no later than within 14 days of receiving the returned product or proof of its return – whichever occurs first.

VII. COMPLAINTS AND WARRANTY

  1. Complaints regarding physical or legal defects of the purchased Product (statutory warranty) or non-conformity of goods with the agreement should be submitted electronically or in writing to:

  2. The complaint should include data allowing for identification of the Customer and order (e.g., name, order number, description of the defect). The Seller will respond to the submitted complaint within 14 business days of its receipt.

  3. If the Product has a defect, the Consumer may request replacement, repair, price reduction, or withdrawal from the agreement in accordance with Civil Code provisions. If the complaint is accepted, the Seller will take appropriate corrective action or refund the Customer the equivalent of the Product price, under conditions specified in the regulations.

  4. In case of disputes related to complaints, the Consumer may seek assistance from the district (municipal) consumer ombudsman, consumer organizations (e.g., Consumer Federation, Polish Consumer Association) or submit a request for mediation or dispute resolution to the consumer arbitration court operating at the Provincial Trade Inspection Offices.

VIII. PERSONAL DATA PROTECTION

  1. The controller of Customers' personal data is Azad Yakubov.

  2. Personal data is processed in accordance with generally applicable law, particularly GDPR and the Personal Data Protection Act.

  3. The Customer has the right to:

    • access their data,
    • rectify (correct) their data,
    • request data erasure,
    • restrict data processing,
    • data portability,
    • object to data processing,
    • lodge a complaint with the President of the Personal Data Protection Office if data processing violates legal provisions.
  4. Detailed information about personal data processing can be found in the Privacy Policy available on the store's website.

IX. FINAL PROVISIONS

  1. In matters not regulated by these Terms and Conditions, provisions of the Civil Code and the Consumer Rights Act, as well as other relevant provisions of generally applicable Polish law shall apply.

  2. Any disputes between the Seller and the Customer will be resolved by common courts according to territorial and subject matter jurisdiction resulting from legal provisions. For Consumers, court jurisdiction is determined according to special provisions ensuring protection of Consumer rights.

  3. The Seller reserves the right to make changes to these Terms and Conditions for important reasons, such as changes in law, changes in payment and delivery methods. The Seller will inform Customers of any planned changes to the Terms and Conditions in advance on the store's website. Changes to the Terms and Conditions cannot violate Customers' acquired rights.

  4. These Terms and Conditions are effective from February 1, 2025.
